Stage 2 Application After Endorsement Refusal – Section 3C Leave

Hi everyone,

I’m looking for some guidance regarding the interaction between a Global Talent Stage 1 refusal and a pending Stage 2 application.

I applied for Stage 1 and Stage 2 together from inside the UK and my Stage 1 endorsement has now been refused. I am currently under Section 3C leave, and I will be submitting an endorsement review within the 28-day period. However, I have not yet completed my biometrics for Stage 2; my biometric appointment is scheduled for later this month.

If the endorsement review is also unsuccessful, what happens to my pending Stage 2 application and Section 3C leave? Will Section 3C continue until UKVI makes a decision on my Stage 2 application, or can it end immediately following the endorsement/review refusal?

Also, does UKVI normally wait for biometrics before making the Stage 2 decision in this situation?

I’m finding conflicting information about this and would really appreciate clarification from anyone who has experienced a similar situation or has reliable guidance.

Stage 2 and Section 3C questions can get quite technical, and immigration advice in the UK is actually regulated. It’s best to speak directly with an accredited immigration lawyer or advisor who’s authorised to give guidance on these matters.

Few immegration solicitors are confused as well, couldn’t give me proper advice. I’m still looking for an expert one. Anyway thank you for your response.
