Need Guidance on Resubmitting Global Talent Visa Application: OC3 & Letters of Recommendation

I was rejected for not adequately demonstrating commercial impact on OC3 and a few other areas. I’m now preparing a new application and need your help with a few questions:

  1. I have letters of recommendation that are 1 and 2 pages long, but the guidelines allow up to 3 pages. Is it okay if I add extra details like evidence, GitHub links, or screenshots, or should the employer include that? Does the letter need to be entirely written by the employer, or can I add additional details to make it 3 pages?

  2. Regarding the MC: You command a high salary or other remuneration for your services, as evidenced by commercial or employment contracts with salary information, including any bonus, equity options, and history of earnings,’—I’m currently working remotely for two companies. Is it okay to submit proof of remuneration from both companies and show that Company A pays XYZ and Company B pays XYZ, and then provide a total of A + B = XYZ? Or do the guidelines require only a single company’s remuneration?

  3. ‘The candidate has shown recognition for work beyond the applicant’s occupation that contributes to the advancement of the field. OC2 is awarded.’ Since I’ve already been awarded for OC2, and the assessors aren’t always consistent, can I mention in the new application that I was previously awarded for OC2 by including my Tech Nation ID in the footer of every OC2-related document?

Answering your questions specifically:

  1. You can add these to your evidence documents towards criteria not in letters.
  • letter has to contain only the letter of recommendation. However if you have support letters (beyond LORs) in criteria then you can create a document incl a 1-2 pages support letter and rest self-documented evidence like you have mentioned.
  1. Submit for both companies. There’s no mandate of submitting payslips for a single company.

  2. You can mention it but it doesn’t guarantee success this time too. However if it has been granted once, chances of success is high for this criteria. However you still need to submit evidences for OC2 because the assessor is not going to look at your previous application. They will assess your new application afresh.

  3. Yes. I will also include evidence for OC2, and in the footer, I’ll add the Tech Nation ID to inform the assessor that I have been awarded this.

New questions, if you don’t mind:
1.
A: For the commercial impact evidence, I have letters of reference. I’m considering including both self-documented evidence and the letters of reference. In the self-documented section, I plan to mention that the company achieved a certain amount of sales due to my work, which is also mentioned in the third paragraph of the letter of reference. Would this approach make it easier for the assessor to evaluate?

B: Additionally, the guidelines mention a limit of 3 pages—is this limit inclusive of the letter of reference (i.e., two self-documented pages and one letter), or can I have three self-documented pages and one letter, making a total of four pages?

C: Since the employer is unable to provide evidence such as total sales figures or bank statements, would the combination of self-documented evidence and a letter of reference be sufficient to demonstrate the commercial impact? Or do you have any suggestions on how to show this evidence effectively?

D: In one of my OC3 cases, I was employed by Company A, where I did work that was sold to a multi-million dollar Company B, although I wasn’t directly employed by Company B. Should I include this in my commercial impact evidence, or would it be classified as consultancy?

You cannot add salary info and GitHub links to LORs. This has to be part of evidence documents towards criteria.

A. All your self-claims must be validation by external evidences: letters are one example of validation but not sufficient.

B. Including support letter. The evidence doc can be max 3 pages.

C. Subjective: usually letters alone are insufficient but really depends on the quality of your evidence. If they are very strong then letters May suffice.

D. If you were employed it won’t be consultancy. However you need external validation to prove your contribution to the multi-million $$. Only self claims are not sufficient.

  1. I’m asking because in my previous application, the feedback mentioned, ‘We also note that the letters of recommendation relate to project work, which generally does not meet the requirements for this visa.’ I’m not sure why the assessor felt this way, as I was employed by these companies. So, I was considering including my employment contract in the new application. Or should I ask the recommender to specifically mention that I was an employee of the company?

Yes you can do that ask them to include that you were employed full time.

You can also appeal this and direct assessor to your salary contracts in your original application if you included. You ll get a fair idea then

A tip for evidence of high remuneration. You can find payscale report/dashboard and attach a screenshot saying you are being paid above the median in your field of expertise in your region.

The LOR can mention your achievements, impact and highlights. Which is further evidenced in the supporting documents/external reference under the criteria’s you choose.

Need your help again. Is it acceptable if I provide both the Letter of Recommendation and the criteria document from the same company? For example, I have a MC from XYZ and have attached a letter of reference to demonstrate the impact of the work. Is it okay if I use the same person for the Letter of Recommendation as well? No you need to have two different people. They can be from the same company but not the same person.
