Yes, you can appeal provided it’s not for the same reason.

The candidate fails to meet the requirements for Optional Criteria 3 due to a lack of evidence of significant contributions to product-led digital technology companies as an employee, founder, or executive. The candidate has provided some evidence of increasing the revenue at XYZ. However, the candidate was a freelance contractor and thus does not satisfy the criteria for OC3.

She appealed against being just a freelance contractor. After submitting the first appeal, the endorsement review decision letter recalled this reason and considered her as a full-time employee in XYZ based on her appeal, but still rejected OC3.

Reason given for refusal for OC3 after the first appeal:

For OC3, the candidate claims that some of their impact has not been taken into consideration. For ABC, the candidate claims increases in user acquisition as well as internal improvements in analytics and reduction on support load. For DEF, the candidate has provided Figma product designs and other artefacts. In XYZ, they worked as a full-time employee (something that the previous reviewer disagreed with). Finally, the candidate has also listed their impact on the ecosystem as a whole with expert articles, … We consider the candidate as a full-time employee in XYZ and agree that the application represents them as a competent professional. However, the impact showcased in the documentation is not enough for awarding OC3. Additionally, in many cases, it is not clear what the candidate’s unique and individual contributions were to some of the metrics submitted and what impact can be attributed solely to them. This decision aligns with the prior review.

According to the official Global Talent guidance, “If the endorsing body chooses to uphold the decision for non-endorsement following the endorsement review, however this time for fresh reasons compared to the original decision, the applicant is permitted to submit a new endorsement review form to appeal the fresh reasons only. In this instance, the review process will restart.

So she sent an email to Home Office to request a new review based on each of the reasons for the new refusal. She filled out a new Appeal form and attached it to the email asking for a second review. A few days later, the HO replied that they have forwarded the appeal to TN.
