Endorsement after 2nd Review [Rejected, Appealed twice & Endorsed]

Hi everyone,
I’ve been following this forum for quite a while.

I applied for Tech Nation Endorsement as a startup owner and technical writer under the Exceptional Promise Route - Business and Technical Profile (from Startup Visa).

I submitted my application for Exceptional Promise on 18th December and got endorsed 1st of March. Endorsement Received after 2nd review requested - Same application.

According to the official Global Talent guidance, “If the endorsing body chooses to uphold the decision for non-endorsement following the endorsement review, however this time for fresh reasons compared to the original decision, the applicant is permitted to submit a new endorsement review form to appeal the fresh reasons only. In this instance, the review process will restart.

Can you even appeal twice, I am consufed there?

Yes, you can appeal provided it’s not for the same reason.

In this case, Reason for rejecting OC3 before review:

The candidate fails to meet the requirements for Optional Criteria 3 due to a lack of evidence of significant contributions to product-led digital technology companies as an employee, founder, or executive. The candidate has provided some evidence of increasing the revenue at XYZ. However, the candidate was a freelance contractor and thus does not satisfy the criteria for OC3.

She appealed against being just a freelance contractor. After submitting the first appeal, the endorsement review decision letter recalled this reason and considered her as a full-time employee in XYZ based on her appeal, but still rejected OC3.

Reason given for refusal for OC3 after the first appeal:

For OC3, the candidate claims that some of their impact has not been taken into consideration. For ABC, the candidate claims increases in user acquisition as well as internal improvements in analytics and reduction on support load. For DEF, the candidate has provided Figma product designs and other artefacts. In XYZ, they worked as a full-time employee (something that the previous reviewer disagreed with). Finally, the candidate has also listed their impact on the ecosystem as a whole with expert articles, … We consider the candidate as a full-time employee in XYZ and agree that the application represents them as a competent professional. However, the impact showcased in the documentation is not enough for awarding OC3. Additionally, in many cases, it is not clear what the candidate’s unique and individual contributions were to some of the metrics submitted and what impact can be attributed solely to them. This decision aligns with the prior review.

So she sent an email to Home Office to request a new review based on each of the reasons for the new refusal. She filled out a new Appeal form and attached it to the email asking for a second review. A few days later, the HO replied that they have forwarded the appeal to TN.

Edits are updates made on your application, it just indicates that it’s being viewed by TN. It’s not always accurate to conclude your endorsement based on an edit pattern.

To see these edits, log in to your TN application portal -> View Application -> Preview.

Please how did she appeal against the freelance contractor reason? I’m stuck with something similar where they nullified my evidence because they counted it as a contract role even when I was working fulltime

Hi, for reference I’ll attach a page from the contract. The most important thing was presenting all evidence to back the fact that the nature of the contract was only because the ‘employer’ and the ‘employee’ were in different countries.

The company was based in Asia so the only/easiest way to comply with accounting and tax laws was to employ independent contractors (as they didn’t use Deel or other employers of record). The section in the contract however states she works FT was explained in the 2nd review.

It might be worth noting that this information only comprised 5% of the submission as it was a previous job, not her current one. So other stronger cases neglected were emphasised in the first review (e.g. her current FT tech job at a startup and the company she founded weren’t acknowledged by the reviewer).

Hello. How did you prove that service agreements are common employment contracts in her country? Did you include URLs of online articles and screenshots as references in the document? Or did you simply explain the country’s customs in text? This information would be very helpful for me.

I got rejected and I’m quite confused now.
For MC - How did she prove the thought leadership in national and international scale?
I’ve provided evidence as startup advisor in Europe, specialist event speaker with over 100 experts attendant in London, a judge for the US National Challenge Competition for children. I’m really not sure how to prove how else to be in “National” and “International scale” if you have any suggestion

I got rejected for all criteria recently and appealed then was endorsed, it’s all about pointing them to important parts on your application.

Hi there everyone;

Should the extension of the review period be considered positive? While some reviews are immediately negatively resolved, some reviews, as far as I understand, take some time and have a possibility of a positive outcome. It has been 15 days since i shared my request of review and I am still waiting (The maximum review period is stated as 28). I would be happy to read about your experiences and thoughts.

There is no such indication of shorter or longer duration of decisions.

@pahuja thanks for the answer. do you have any idea or prediction about the ratio of positive returns to appeals? I am aware that this is definitely a situation that varies depending on the content, but if there is such information, I would like to know it.
