Applying ILR for a dependent combining times as dependent on GTV and student visa to complete the 5 years required GTV

Thank you for this useful forum. Do anyone here had experience or know anybody who got ILR for their dependent (wife) by combining GTV dependent and student visa dependant to meet the five-year requirement? I’ve just spoke with an immigration solicitor, and he advised me that my partner can’t use the time spent as a dependant on my student visa, and she must be dependent on work visas for 5 years in order to be eligible for ILR as a dependent. He told me that if she applied now, her application would be refused, and she would have to reset the time, beginning from zero. This is quite disappointing as my wife’s visa will expire next week, and I hoped she could apply for ILR using both dependant visas (GTV and student). Any help with this issue would be highly appreciated.

Your partner cannot use the time spent on student visa to meet the 5 year continous residency criteria. She has to spend 5 years as a dependent on GTV to meet the criteria.

Or If you want to save money,

You could get your ILR first. She can apply a family visa as a dependent on your ILR.

thank you very much for your response, but I found many people in forums who have the same situation and their partner got ILR as the main GTV holder has ILR and the dependent partner was dependent on their GTV when they applied for ILR using this route. Do you know people got refused about this please?

@Wlak123 It’s a bit confusing what you asked.

Do you mean a case where :
A dependent on GTV applying for ILR while their main applicant is still in GTV?

No the main applicant got ILR. Her dependent on GTV wants to apply for ILR combining times as his dependent on Tier 4 student visa and GTV.

Did you add your wife as dependant to your GTV once you got endorsed?! I understand from the context that she was on student visa and therefore the period is not considered. I dont think you added her as dependant from the start?!

if that is the case then its better to process your papers and add her as dependant. Student visa definitely by all means not counted for ILR unless she wants to have 10 years path.

As @Maya mentioned, The dependent cannot combine Tier 4 and GTV.

This is misleading. GTV dependent can extend their visa under GTV after the main applicant applies for ILR. Applying for family visa is not the correct route for extending GTV dependent visa.

Thank you. Yes they can extend global talent dependent visa but also if the main GTV holder got ILR, the GTV dependent can apply for ILR after 3 years combining time on GTV dependent with any time they spent as dependent on any other visas including student dependent visa. Is this correct?

I have seen someone on this forum combine time as dependent on students visa but it is still a great area as there is no clear rule in that.
