ILR Clarifications self & Dependents

Hello Friends,

I am in need of a advise on my ILR application - i know there are lot of discussions on this topic (in this forum) but each & every ones ask/doubt is unique.

So here we go:
Main applicant is T2G (Skilled worker) - visa validity is up to 5th Jan 2024 (5year completed) and then will be eligible for ILR - how are we calculating this 5 years - Physical entry in to UK or as per the “Visa valid from” in the vignette ?.so that i can calculate that 28 days accordingly.

Dependents visa is valid up to 5th Jan 2024 (obviously) but my issue here is they(spouse & kids) transferred their ICT main (wife) / ICT dependent visa (kids) to T2G skilled dependent visa after a month (due to an appointment unavailability at that time). Now 3 of them are in short of 7 days including that 28 days period for the ILR (i.e 35 days).

I want to know - what would be the correct way to get this ILR process without any issues.
Do i need to extend their visa - i.e Dependent visa (based on my ILR GWF reference ) ? or Submit the application for all 4 of us on 4th of January & schedule the appointment for biometric within 45 days - ideally 10th of February(3 of them will get the eligibility - i.e 5year completion)

or any other options which i can consider.

Would be great to hear back your thoughts / suggestions please.

  1. How is continuous residency calculated for ILR?
    Your eligibility start date for ILR may be calculated from either the date you entered the UK or the “valid from” date on your BRP (Biometric Residence Permit), depending on whichever is later.

  2. 7-day shortfall issue.
    To qualify for ILR, applicants must complete a continuous 5-year residency period, with the option to apply up to 28 days before this period ends. In your case, this 7-day shortfall should not be an issue. When you submit your application, the processing time will likely mean the 5-year requirement is met by the time the ILR decision is made.

You may submit your applications together before your current leave expires. Once submitted, you can schedule the biometric appointments, and by that time, the continuous residence requirement should be fulfilled.

P.S.: I’m not a solicitor, and my advice is based solely on personal interpretation of the Home Office’s official guidelines.
