ILR Application

Dear All,

Hope you can help me with this easy question. I am approaching my ILR application under the Global Talent Visa route and I need just a clarification. I have arrived in the UK on June 21 under skilled worked visa. I have been continuously working under this scheme till January 24. Then I have applied for the Global Talent Visa (Exceptional Promise, endorsed by Royal Society so the requested time in the UK to apply is 3 y) and got my new visa valid from April 24. So I had 2 months break, and I was outside the UK on those two months. I still maintained my bills and rent in the UK in that period, and I have started a new job on April 24. My question is: are those two months break affecting my elegibility to apply for the ILR? I am still meet there requirement for the ILR to do not have spent more than 180 days within any 12 months period in the last three years, but I would like to double check before applying because the price is really high and I want to be 100% sure to get the ILR without the risk to lose money. The rule is 180 days, and two months is less than that. You should be good.

btw, this forum is fo digital technology GTV and in this visa Exceptional Promise will need 5 years. Is that different for Royal Society GTV?

Many thanks for your answer. I say 3 years because of what I have found on the gov website as follows:

Global Talent

The time you must have been in the UK depends on how you were endorsed.

You can apply after 3 years if you were endorsed by either:

the British Academy, the Royal Academy of Engineering, the Royal Society or UK Research and Innovation
Arts Council England or Tech Nation - this must be as a recognised leader (‘exceptional talent’)

Or if you were endorsed by Arts Council England or Tech Nation as an emerging leader (‘exceptional promise’), you can apply after 5 years.

If you did not need an endorsement for your visa because you had won an eligible award, you can apply after 3 years.

Form my understanding 3 years should be enough since I was endorsed by the Royal Society, or maybe I misunderstood? Thank you very much for your help :slight_smile: Ivan

You’re right - it looks like Royal Society endorsees can apply for ILR after 3 years. Good for you :slight_smile:
